Terms of service

Plain terms for a plain deal: play free without an account, own the unlock outright, subscribe only if you want cloud sync across your devices, and keep what you make.

The service

Fenophone is a music instrument that runs in your web browser. You play it live, you decide what to keep, and what you keep is yours to carry out. These terms cover the instrument, this website, accounts, purchases, and sharing.

You do not need an account to play. The core instrument works fully signed out: play, capture loops, save a session on your device, and share a setup link without signing in and without paying. An account only adds sharing with attribution, your purchases, and — if you subscribe to Plus — syncing your sessions across devices.

The free tier

The free tier is the full instrument, not a trial. Every control, every shipped genre pack, capture, and the loop stack are free, with no time cap. It includes one saved session on your device and setup-link sharing.

There are no ads — in any tier.

The one-time unlock

The headline purchase is a one-time unlock: pay once, own it forever. It is not a subscription and it never renews. It adds:

Paying, and changing your mind

Prices are shown plainly before you pay. Payment is handled by our payment processor; we never see or store your card details.

Every one-time purchase and every Plus subscription comes with a 14-day, no-questions refund window, handled through the billing portal.

Plus, the optional subscription

Plus is the only recurring purchase, and it is optional: it adds cloud sync across your devices, and access to any subscriber packs released while you subscribe. It is never required to play, to export, or to keep your music.

You can cancel at any time, in one step, from the billing portal. Cancelling stops cloud sync and any subscriber-pack access — and removes nothing else. Cancelling, or letting Plus lapse, never takes away the one-time unlock, export, exact-take sharing, the base library, or packs you have already downloaded. They stay yours.

If a renewal payment fails, nothing pauses at once: there is a 7-day grace period while the payment retries. Only after that do cloud sync and any subscriber-pack access pause, until payment resumes — the unlock and your downloaded packs are never affected.

Your music and your data

What you make with Fenophone is yours to use. You have a perpetual, irrevocable, royalty-free, worldwide license to use the music you make with the instrument, including commercially, and we will never assert ownership against that use.

Every built-in sound is synthesized and cleared for commercial use, so what you export carries no third-party claims.

A formal legal opinion on output ownership is being obtained; the license above stands regardless.

Your work is never trapped. Signed in, one click exports every session and capture as portable files — the same bundle that serves your data-export rights. Deleting your account is real deletion: live data is removed immediately, and backups age out within 30 days.

If Fenophone ever winds down

Continuity is a written commitment, not a hope. If the service is ever discontinued:

Fenophone is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We work to keep the instrument fast and dependable, but we cannot promise it will always be uninterrupted or error-free.

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, and our total liability for claims connected to the service is limited to the amount you paid us in the twelve months before the claim arose. Where the law does not allow one of these limits to apply to you, it does not.

Fenophone is not directed to children, and we do not knowingly collect children's data. You must be at least 13 years old (or the equivalent minimum age where you live) to create an account; a purchase additionally requires that you can lawfully make it, or that a parent or guardian makes it for you.

If these terms change, the updated version is posted on this page with a new date, and a material change is announced in the product before it takes effect. No update shrinks what you have already paid for: the unlock, your exports, and your music stay yours.

These terms will receive a formal legal review before Fenophone's public launch; that review may refine the wording, and the commitments above are the floor it starts from. Last updated August 7, 2026.
